Anne-Marie Rogers had been prescribed the breast cancer drug Herceptin, now widely available, but the local primary care trust (PCT) at the time denied it to her based on cost.
Yogi Amin from Irwin Mitchell represented Anne-Marie, and David Standard as Head of Communications at Irwin Mitchell ensured the case made national headlines as Anne-Marie fought for the drug prescribed by her consultant.
The PCT had argued that the drug would only be given in exceptional cases. The legendary David (now) Baron Pannick, KC acting for the claimant, asked simply for the PCT to define 'exceptional'. They couldn't - the case was won.
In a landmark ruling, the master of the rolls, Sir Anthony Clarke, and fellow appeal court judges Lord Justice Brooke and Lord Justice Buxton said the policy of the PCT was irrational and "therefore unlawful".
